• Not have previously been suspended or removed from the Platform

4. User Responsibilities

As a user of Zivva MyClassifieds, you agree to:

• Provide accurate information: All listing details must be truthful and not misleading
• Respect other users: Communicate professionally and respectfully
• Complete transactions honestly: Honor your commitments to buy or sell
• Follow safety guidelines: Meet in public places, inspect items before purchase
• Report issues: Flag inappropriate content or suspicious users
• Maintain confidentiality: Do not share others' personal information

5. Prohibited Items and Activities

5.1 Prohibited Items

The following items are strictly prohibited on Zivva MyClassifieds:

• Illegal items: Drugs, weapons, counterfeit goods, stolen property
• Hazardous materials: Explosives, toxic substances, flammable items
• Adult content: Pornography, sexual services, adult toys
• Endangered species: Animals, plants, or products made from endangered species
• Human remains: Body parts, organs, or remains
• Government IDs: Passports, driver's licenses, identification cards
• Financial instruments: Counterfeit money, stocks, bonds
• Prescription medications: Any drugs requiring a prescription

5.2 Prohibited Activities

• Posting false or misleading listings
• Engaging in fraudulent transactions
• Harassing or threatening other users
• Spamming or unsolicited advertising
• Attempting to bypass platform fees
• Creating multiple accounts
• Using the platform for money laundering
• Posting copyrighted content without permission

6. Listings and Transactions

6.1 Creating Listings

• Listings must accurately describe the item including condition, price, and location
• Use original photos or properly licensed images
• Do not list items you do not own or have the right to sell
• Mark items as sold promptly after transaction completion
• List items only in appropriate categories

6.2 Transaction Process

• Transactions are between buyers and sellers directly
• Zivva MyClassifieds does not guarantee or facilitate payments
• We recommend meeting in person and inspecting items before payment
• Use secure payment methods like M-Pesa with confirmation
• Document all communications through our platform

6.3 Pricing and Fees

• Basic listings are free (subject to limits)
• Premium features have associated fees (see subscription plans)
• All fees are clearly displayed before purchase
• Fees are non-refundable unless otherwise stated

7. Intellectual Property

All content on Zivva MyClassifieds, including logos, designs, text, graphics, and software, is the property of Zivva MyClassifieds or its licensors and is protected by copyright and intellectual property laws.

• You retain ownership of content you post on the Platform
• By posting, you grant us a license to display and distribute your content
• Do not post content that infringes on others' intellectual property rights
• Unauthorized use of our trademarks is prohibited

8. User Content

By posting content on Zivva MyClassifieds, you represent and warrant that:

• You own the content or have permission to use it
• The content is accurate and not misleading
• The content does not violate any laws or third-party rights
• The content is not harmful, offensive, or inappropriate

Zivva MyClassifieds reserves the right to remove any content that violates these Terms at our sole discretion.

11. Indemnification

You agree to indemnify and hold Zivva MyClassifieds harmless from any claims, damages, losses, liabilities, costs, and expenses arising from:

• Your use of the Platform
• Your violation of these Terms
• Your violation of any third-party rights
• Your transactions with other users
• Your posted content

12. Termination

Zivva MyClassifieds may terminate or suspend your account immediately, without prior notice or liability, for any reason, including if you breach these Terms.

Upon termination:

• Your right to use the Platform will immediately cease
• Your account will be deactivated
• Listings will be removed from the Platform
• You may not create a new account without our permission

13. Modifications to Terms

Zivva MyClassifieds reserves the right to modify these Terms at any time. Changes will be effective immediately upon posting on this page. Your continued use of the Platform after any changes constitutes acceptance of the modified Terms.

We will notify users of significant changes via email or a prominent notice on the Platform.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Kenya, without regard to its conflict of law provisions.

Any disputes arising under these Terms shall be resolved in the courts of Nairobi, Kenya.
